These are your GasMaster Members Only Discount Club Terms and Conditions. Please read them carefully and keep them for your records. In these Terms and Conditions, "Prepaid Gas Card" and "Gas Card" means any of the Prepaid Gas Cards you have purchased or been awarded from the GasMaster Members Only Discount Club. "You" and "Your" means the person who has received the Prepaid Gas Card. "We", "Us" and "Our" means GasMaster Discount, Inc., our successors, affiliates or assigns. By accepting and using your Gas Card, you are agreeing to these Terms and Conditions. The Gas Card is not a credit card it is a prepaid cash card.

GasMaster Discount Club Distributorship and Membership:

Prepaid Gas Cards are offered to individuals over the age of 18 that lawfully enter into and form contracts under applicable law, and by using our Prepaid Gas Cards you represent and warrant to us that you are such an individual. The amount of funds shown on the records of the card issuer shall be deemed the balance on the Gas Card, unless you can prove to us otherwise to our satisfaction in our sole discretion.

Membership Term
Your Membership is effective for a period of twelve months (1 year) following the membership enrollment date. The annual membership fee is $159.00.

Distributorship
The cost of Distributorship is a one-time cost which includes a 1 year membership to the GasMaster Discount Club, the cost of startup presentation collateral and the first month of maintenance. You will be able to access your website’s Back Office within 24 hours of enrollment, and will receive your Distributor’s kit within 7 days of enrollment. In order to maintain your Distributor status, you must fulfill a maintenance cost of $29.00 per month which will be deducted from your commission check or charged to your credit card if you have not made commissions. Pay periods begin on the first day of each month and end on the last day of each month. Commissions will be posted by the 15th day of the month following the pay period. Your Distributorship may be terminated at any time by You or Us with 30 days written notice. Termination does not entitle the Distributor to refund in part or whole. Please see section on Cancellation for details.

Purchase of Prepaid Gas Cards:

You may purchase your prepaid gas cards once you have received your GasMaster Membership Card.

Card Limitations
Please visit the teller to complete payment before attempting to fill your tank. You must have sufficient, available funds to pay for all Gas Card transactions at merchants. If the purchase amount is greater than the available funds, the difference may be paid for with cash, check or credit or debit card, subject to the policy of the merchant. If the merchant attempts to process the Gas Card for more than the available funds, the transaction will be declined. You may confirm your available balance or transactions online or by phone using the information listed on the back of your Gas Card where applicable. You may only use your card in the manner and for the purposes described in these Terms and Conditions. Your Card may not be used for illegal transactions or for any type of pre-authorized transaction such as recurring monthly payments, dues or fees.

Billing
For security reasons your shipping address must match your billing address.

Shipping and Handling
At the time of purchase, you acknowledge and agree that First Class shipping by USPS is not guaranteed.

Documentation of Transactions
Transaction receipts may be downloaded from your web account or may be transmitted by email or fax upon request. Retain the receipt for your records. For Gas Card purchases, you may access your order history and balance available information by phone using the number on the back of the Gas Card. You may review commissions, statements and enrollment activity online at www.TheGasMaster.com.

Disputes with Merchants
You agree to make a good faith effort to settle all disputes about purchases you make using your Card with the merchant who accepted the card.

Your Liability for Card Use
Report it AT ONCE if you believe your Card has been lost or stolen. Call the number on the back of your Gas Card or visit the website indicated on the back of your Gas Card. GasMastr Discount, Inc. does not accept liability for any lost, damaged or stolen cards and replacement of such in part or in whole is subject to the Terms and Conditions of the issuing bank.

Disclaimer of Liability
In providing the Gas Card service to you, we disclaim any duty or responsibility other than those expressly set forth in these Terms and Conditions.

Inactivity Fees and Expiration
Prepaid Gas Cards may incur fees for inactivity beginning at a minimum of 7 months from the date of activation.  Inactivity fees, if and where charged, will be applied monthly until the total value of the Gas Card has been exhausted. Gas Cards may expire a minimum of 12 months from issue. There may be fees associated for reissue if the Gas Card is not fully used by the expiration date. Please see the Terms and Conditions provided by the Card issuer for details.

Cancellation
You may cancel your membership within 3 days of enrollment for a full refund. No refunds will be processed after 3 days of enrollment, if your first Prepaid Gas Card has already been shipped, or if you have already received Free Gas Cards or other benefits for new member referrals.

Amendments
Terms and Conditions are subject to change without notice. We will make every effort to notify you of changes by mailing or emailing notice to you at your last address on our records within 90 days of the effective date of any amendment that results in an increased fee or charge, an increase in your liability, a reduction in Gas or Member Card services, or stricter transaction limitations. GasMaster Discount Inc offers a wide range of products to its members and the inability of the company to continue to offer any product or any number of products including prepaid gas cards does not constitute a breach of agreement between the company and its members as membership is not contingent on the availability of any particular product or any number of products. GasMaster Discount Inc reserves the right to discontinue its distribution of any product or any group of products without prior notice to members. GasMaster Discount Inc also reserves the right to adjust or modify discount percentages on products including prepaid gas cards, or to discontinue the offering of discounts on any or all products without notice to members.

Assignment
Members may not transfer or assign their Membership rights to any other person without prior written consent from the company.

Severability/No Waiver
If any provision of these Terms and Conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. Our failure to enforce the strict performance of any provision of these Terms and Conditions will not constitute a waiver of our right to subsequently enforce such provision or any other provisions of these Terms and Conditions.

Governing Law
These Terms and Conditions and all transactions hereunder are subject to the laws of the State of Florida, the laws of the United States and GasMaster Discount, Inc. rules and regulations.

The terms "you", "your", and "yours" refer to anyone accessing, viewing, browsing, visiting or using the Site. GMD Mall's trademarks may not be used in connection with any product or service that is not GMD Mall's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits GMD Mall. All other trademarks not owned by us that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by GMD Mall.

License and Site Access
GMD Mall grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of GMD Mall. Unless you are a registered Distributor with GasMaster Discount Inc., this license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of GMD Mall. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of GMD Mall without express written consent. Your Account

GMD Mall does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. Comments and Communications
If you submit material via email, and unless we indicate otherwise, you grant GMD Mall a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant GMD Mall and sub-licensees the right to use the name that you submit in connection with such content, if they choose.

Risk of Loss
All items purchased from GMD Mall are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our suppliers’ delivery to the carrier.

Product Descriptions
GMD Mall attempts to be as accurate as possible. However, GMD Mall does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by GMD Mall itself is not as described, your sole remedy is to return it in unused condition.

Pricing
Except where noted otherwise, the MSRP displayed for products on our website represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The MSRP is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day.
